Detained in York, PA Regarding a Deportation Matter? - What You Need to Know

Detained in York, PA Regarding a Deportation Matter? - What You Need to Know

Deportation and Removal in the United States is a very difficult area of law to navigate. However, it must be mastered, in order to ensure the best legal defense in this complex area. Especially, in York Pennsylvania Immigration Detention center, the failure to ensure a solid legal defense for you or your family member could be detrimental resulting in removal from the United States within a few days of arrival.

York Pennsylvania detention facility actually houses the U.S. Immigration office and ICE ERO. With all branches of the Department of Homeland Security and Executive Office of Immigration Review in the same building, deportation decisions and removals from the United States are very fast. Furthermore, the judges are strict and will not grant multiple continuances and chances to represent a clients immigration defense.

If you or your family member are placed in York Detention Center it is important to know the following:

•1. Asking your immigration attorney to attend your hearing(s) at least once in YORK, PA is essential. This court is remote, so many lawyers will only represent you by phone with the judge and not attend in person. A telephonic hearing is not sufficient by itself where the stakes are very high if a client is moved to this detention facility.

•2. Consider whether a change of Venue from York, PA is possible where you are closer to family and a support system. There are many reasons to seek a change of venue from York, PA based on its remote and removed location for most detained clients.

•3. Voluntary Departure. This is an option frequently offered by the U.S. Immigration Judge and agreed upon by the Office of Chief Counsel ("OCC" - the attorneys for the government). However, it is important to understand that even with Voluntary departure one is often not eligible to be admitted back into the United States. Accepting a final removal order in many instances may be a better option if clients want to maintain their rights to appeal or file a Stay of Removal with the Department of Homeland Security.
