Over the years, our law firm clients have included foreign nationals faced with inadmissibility issues at various U.S. land and airport borders. For instance, a couple whose H-1B visas had been erroneously denied prior, found out for the first time upon arrival to the United States. Consequently, they were denied admission to the United States. However, the couple was paroled into the U.S. when our lawyers entered their representation with the Department of Homeland Security (“DHS”); and they were permitted to remain for months while the appeal was in process and eventually granted.
Another example, is where one of our Canadian clients attempted to enter the U.S. to make a connection flight from Buffalo to Florida and go on a cruise. She was surprised that after over 25 years of crossing at the Canadian border without issue, she was suddenly flagged by U.S. Customs Border & Patrol (“CBP”) and not permitted to enter based on an old shoplifting charge/conviction at age 19. The result, loss of thousands of dollars for a preplanned vacation with family and friends.
Our lawyers contacted CBP and applied for the client to be paroled into the U.S. for 2 weeks in order to go on the cruise, and promptly return back to Canada. With certain promises and parameters set in place, CBP granted ‘parole’ and our client and her family enjoyed their Caribbean cruise and returned without issue.
